01Acceptance of Terms
By accessing or using the Maklor platform (the "Service") provided by Mulklick GmbH ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service.
02The Nature of the Service: Preparation, Not Advice
Maklor is an operational intelligence and workflow platform. It is not a financial advisor, legal counsel, or real estate broker.
- The valuations, market signals, compliance checks, and analytical outputs generated by Maklor (including its AIREA AI features) are provided strictly for informational and preparatory purposes.
- Maklor does not issue personal recommendations on financial instruments, legal strategies, or transaction decisions.
- Users are solely responsible for verifying all data and consulting with qualified, licensed professionals — notaries, tax advisors, mortgage brokers, legal counsel — before making any binding real estate or financial decisions.
03User Obligations
You agree to:
- Provide accurate and up-to-date information during registration and use.
- Maintain the confidentiality of your account credentials.
- Use the Service in compliance with all applicable Swiss laws, including the nFADP and the Unfair Competition Act (UWG).
- Not attempt to reverse-engineer, scrape, or disrupt the Maklor platform or its underlying intelligence engine.
04Intellectual Property
All content, features, and functionality of the Maklor platform — including but not limited to the "Maklor" and "AIREA" names, logos, software, and analytical methodologies — are the exclusive property of Mulklick GmbH and are protected by Swiss and international copyright and trademark laws.
05Limitation of Liability
To the maximum extent permitted by Swiss law, Mulklick GmbH shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service. This includes, but is not limited to, lost profits, lost mandates, or transaction delays. Our total liability for any claim arising from these Terms shall be limited to the amount you paid us for the Service in the twelve (12) months preceding the claim.
06Service Availability and Modifications
We strive to maintain high availability, but we do not guarantee uninterrupted, error-free operation. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice to affected users.
07Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the substantive laws of Switzerland, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Zug, Switzerland.
